SIR – Just as the default retiring age of 65 has been abolished here, will that position be changed due to yet another European Court ruling?
Another EU country has successfully challenged this in a public sector job where retiring at 65 was always compulsory, and won; the case based on the obscure principle of ‘ability’ to carry out duties involved giving that employer the necessary leeway.
Many companies here will welcome this as an escape route from being forced to employ older staff against their will.
However, they may now have to pay at least statutory redundancy money to get rid of them.
