An HIV positive asylum seeker has been cleared of forcing a woman on to her bed and raping her.
It took a jury at Bradford Crown Court less than 40 minutes today to acquit Nqobizitha Ngwenya, a 30-year-old Zimbabwian.
He denied raping the 24-year-old woman at her home in the Bradford area on April 25 this year.
Ngwenya pleaded guilty on July 10 to obtaining work as a cleaner at a nursing home in the Bradford area by deception.
He used the false name "Maxwell" and lied about his immigration status, the court heard.
Judge James Spencer QC sentenced Ngwenya to two months imprisonment but he was released immediately because he had been remanded in custody for four months and five days.
Prosecutor John Lodge said deportation papers had been served on Ngwenya.
Defence barrister Ayaz Qazi said Ngwenya was a family man, with young children, who suffered from a potentially fatal virus.
Ngwenya told the jury the woman arranged to have sex with him the day before and fully consented.
He said he wanted to use a condom but she insisted they did not have time.
