Lottery winner Errol Active has been cleared of punching a girlfriend after finding her in bed with another man.

The 40-year-old, who won nearly a million pounds on the National Lottery several years ago, was alleged to have punched Cheryl Andrews in the face during an incident at her home in Allerton earlier this year.

Active, of Yew Tree Close, Shipley, was found not guilty of common assault after a trial at Bradford magistrates court.

Miss Andrews told the court how she returned home from an evening out drinking and phoned a male friend, who later went round to the house.

She eventually fell asleep and was later woken by the sound of her friend and Active arguing on the landing. She told them to stop it, but Active came over to her and punched her in the face, she added.

She then grabbed their 20-month-old son and ran downstairs, before calling the police and sitting in a taxi in Allerton Road until they arrived.

Giving his evidence, Active said he arrived at the house to find Miss Andrews in bed with their baby son and another man.

"I was shocked to see him there," he said. "He just got up and lunged at me and we began scuffling."

The man then pushed him aside and ran off, and he chased after him.

Active admitted he was drunk at the time, but said that although he was angry with Miss Andrews, he did not hit her.

Defence solicitor Phillip Ainge submitted there were inconsistencies in the evidence given by Miss Andrews and said there was very little independent evidence as to what happened in the bedroom that night.
