The boxer shorts of an alleged rapist had the blood of his victim on them, a Court heard.

Jason Halliley, 30, is accused of raping his dying girlfriend, Rachel Mooney, while she was in a "progressive state of unconsciousness" after taking a drugs overdose.

A jury at Leeds Crown Court heard that when Halliley was arrested the boxer shorts he was wearing had the blood of his 27-year-old girlfriend on the front.

Forensic scientist Peter Grant also told the court that the bottom sheet of the bed in their flat at Chadwick Fold Lane, Mirfield, had some blood stains, both Miss Mooney's.

Prosecutors claim that Halliley raped his girlfriend twice, causing serious internal injuries.

She never regained consciousness and died from the drugs overdose.

But under cross-examination Mr Grant admitted that his findings also provided "moderately strong support for Jason Halliley's version of events".

On the third day of the trial the jury heard how Halliley told police he had been trying to end the relationship with Miss Mooney on the night she died.

Detective Constable Shaun Bartram, of Dewsbury Police, told the court: "He said he had talked about ending the relationship and she said she would rather die."

Halliley admitted having sex with Miss Mooney and noticed "she was responding in a surly kind of way" but still thought she was consenting.

He said he fell asleep after drinking and taking sleeping tablets and when he awoke the next morning her lips were blue.

Miss Mooney worked as a call handler at a Halifax insurance brokers.

Halliley admits causing grievous bodily harm but denies causing grievous bodily harm with intent and two counts of rape.
