A bailiff who was attacked and racially abused as he carried out a repossession has been awarded £1,500 compensation by a judge.

Gary Bovan suffered a fractured cheekbone in the incident at a former takeaway in Manningham Lane, Bradford, in 2000, Bradford Crown Court heard.

The shop owner Munawar Hussain, 28, a married father-of-three, was jailed for two years and three months after a jury convicted him of affray and racially aggravated assault.

The court heard that Hussain and his family had been involved in a dispute with Bradford Council arising out of a compulsory purchase order for properties, including the restaurant.

Hussain and his family said it was worth £200,000 but the Land Tribunal awarded them £47,500.

Hussain's barrister John Topham told the court that even now they had still not been paid that money by the Council.

During the violent confrontation, Mr Bovan was pushed against a display cabinet and grabbed by the throat.

Prosecutor Austin Newman said at one stage Hussain lashed out with a T-square taken from a tool box and also threatened Mr Bovan with a screwdriver.

In addition to the compensation, Hussain, of St Leonard's Road, Bradford, will have to pay £470 costs. Mr Topham conceded that he could offer no mitigation.
