MURDER squad detectives probing the sudden, unexplained death of Bradford City fire disaster hero David Hustler have submitted a file on the case to the Crown Prosecution Service.

Detectives have concluded their inquiries and believe there is sufficient evidence to consider charges.

Prosecutors will now decide whether to take the case to court.

Mr Hustler, 76 – who was awarded the Queen’s Gallantry Medal after rescuing two people during the Valley Parade disaster – died in hospital a year ago following a short and unexpected illness.

He had been suffering from vascular dementia and Alzheimer’s and had been living at Meadow Green residential home in Dale Lane, Heckmondwike, owned by Kirklees Council.

Detectives investigating Mr Hustler’s death had been examining whether his death was linked to the care he received.

The crime team has used the services of a top-level geriatrician.

Detectives began an investigation into the circumstances leading up to his death after concerns were raised by Mr Hustler’s family.

Officers have interviewed staff at the care home and medical experts to establish whether there was any link between his death and the care he received at the home.

A voice recognition expert is thought to have been brought in to help verify what officers have been told.

Detective Superintendent Simon Atkinson, of West Yorkshire Police’s Homicide and Major Enquiry Team, who is leading the investigation, confirmed the matter was now in the hands of the CPS.

Det Supt Atkinson said: “We have completed our inquiries and have put a file on the case to the Crown Prosecution Service for them to consider.

“We are now waiting for the CPS to review the case to see if they think there is sufficient evidence for a realistic prospect of conviction.”

The move has been welcomed by Mr Hustler’s son, Simon, a 49-year-old builder.

Earlier this year, Mr Hustler said a final report was being awaited from the doctor helping the investigation, which would be passed on to the CPS.

He said the expert was looking at all aspects of Mr Hustler’s care and treatment to see if it was appropriate in the circumstances.

Mr Hustler, a grandfather, who was formerly of Shipley, died at Dewsbury District Hospital, on Wednesday, October 28, last year.

At Valley Parade, on the fateful day of May 11, 1985, Mr Hustler saved Kathleen Kelly from the fire, before running back into the blazing stand to rescue teenager Matthew Wildman.
