Driver fights bus lane penalty after being diverted for Bradford City Runs event

A driver who was one of 223 fined for going into a bus lane on the day of the Bradford City Runs is appealing the decision with an independent adjudicator.

Nigel Dixon was issued with the £60 Penalty Charge Notice (PCN) after driving in the restricted area on Bridge Street on October 27.

Road closures were in place for the event, organised by Bradford Council and the Bradford Athletics Network, from 8am until 2pm.

The 55-year-old is disputing the notice because stewards were diverting traffic to Bridge Street and his breach was unintentional. Not knowing the city centre well, he followed other cars and assumed the bus lane restrictions were suspended to allow for people having to take alternative routes.

An initial appeal to Bradford Council failed, with the local authority saying, “once diverted, motorists were expected to comply with traffic regulations as normal.”

Mr Dixon, of Sunningdale Crescent, Cullingworth, is now waiting to hear from the Traffic Penalty Tribunal.

“If it had just been me and I was the only car that went that way, I’d have thought obviously I’m the only one that got it wrong. I’m really, really aggrieved. It’s not the money, it’s the principle,” he said. Mr Dixon expects to give evidence to the adjudicator in the next few days and said he would point out how many people were issued PCNs.

“You would think they [the Council] would look at those figures and say ‘something was obviously going on here,’” he said.

If all drivers paid the fine within 14 days, meaning it drops from £60 to £30, the Council would net £6,690 from the notices issued on October 27.

A Council spokesman said: “About 20 per cent of people [issued PCNs] appealed and there are currently four cases with the independent Traffic Penalty Tribunal awaiting hearings.”

Council documents sent to the adjudicator acknowledge there was a road closure in place, but said “no other restrictions were suspended.”

“It appears that the appellant, not knowing the area, simply followed the vehicles in front. We can confirm they were issued PCNs as well,” the document says. “The appellant’s mitigation is not compelling enough for us to cancel this PCN, but if this appeal is dismissed we would accept the discount rate.”

Mr Dixon was on his way to Leeds when he drove into the city centre along Sunbridge Road. He intended to take his usual route and turn onto Tetley Street, but was directed further along Sunbridge Road as the side street was closed.

A second marshal at the junction with Goodwin Street advised him to continue along Sunbridge Road, which turns into Bridge Street. But instead of avoiding the buses only section of Bridge Street, by using Market Street and Bank Street, drivers carried straight on.

Bradford Council Appeals and Adjudications Officer Gary Leeming said: “No vehicles would have entered the bus lane on Bridge Street if the clear signs had been followed.”

I feel sorry for this chap. Bradford Council good at chasing easy targets, but not so good at dealing with scumbag dog muck culprits, or the fly tippers, or the non payment of Council Tax. oh and can Bradford council be fined for not dealing with street lighting.

guess the rest
I Appealed of course knowing it would probably be futile and of course it was,

If they took this type of stuff seriously, and got one of those video enforcement cars ; which are being used in various party of the country to record parking / driving violations, and drove it round Manningham / Oak Lane / Girlington / Whetley Hill / Duckworth Lane areas (or basically within a 1 mile radius of Toller Lane Police Station!!) for a couple of hours, they would make £££MILLIONS£££

well said, I have often thought if a TV company put cameras on the traffic lights at 4 lane ends and the kwik fit lights a bit lower down this would make for cracking TV. Some of the stunts I see there are just unbelievable.

More cars seem to stop on the yellow zig-zags or double park with every fresh intake of pupils.

I have every sympathy with this driver. Anybody who drives around a city centre these days is confronted by such a forest of badly co-ordinated signs, road markings and other street furniture that it has become almost impossible to to keep track of these.
II agree with the above comments, the really bad and dangerous drivers ought to be the priority, like those who drive through red traffic lights.

Bradford centre will be even worse than it is during the half 5 rush hour. Imagine the dangerous drivers then going over pavements, ignoring red lights and speeding through side streets. Sort it out BMDC.

Your assuming more people will come by car to Bradford when Westfield opens.
It was said the City Park would bring lots in before it was done, and lots of money too.

I totally agree, the council are unfair. I have been caught out by not knowing the area and then ending up on a "very short" bus lane that I couldn't get off.

Should be dealing with the gangsters that drive around town flounting road laws repeatedly..... but they won't; as people say they only go for the easy target! It's disgusting.

clear signing by marshalls and diversion signs should have been placed, even locals won't know where you are expected to go if being diverted, you rely on them to steer you right.

This is not about race. It's about Bradford council raising revenue and hitting the long suffering motorists.
Any vitriol should be directed at them. Serial shoplifters and other criminals who commit crime with impunity are often cautioned, signed up to behaviour contracts or given conditional discharges. Why doesn't the same apply to minor traffic offences such as this?
The answer is obvious. Treat the council like they are the enemy, because thats how they see you!

I work in a different town every day throughout the uk and so far this year have managed to get three bus lane fines which comes out of my own pocket, I asked my manager for help,he just said I should pay more attention when driving,saying your not familiar with the area won't wash I'm afraid.
