SIR – Elaine Neale claims the proposed charge of £200 per year for health care for migrants is minuscule (T&A, July 10), it most certainly seems like it and it is also ‘illegal’ under EU law.
While the UK Government can charge migrants from outside the EU anything they like, the same does not apply to migrants from EU countries. Under EU law, all EU citizens have to be treated the same as citizens in the EU country they migrate to – any EU migrant who comes to the UK has be to afforded the same benefits and healthcare provision as a British citizen.
The Government is proposing a crackdown on EU migrants benefits, but they know very well what they are proposing is illegal under EU law, indeed the EU Commission has already threatened to take the UK to court if they limit benefits to EU migrants.
