A MAN who was twice the drink drive limit has been jailed after a confrontation on the motorway over his driving.

Adam Fairfoot Smith, 29, was driving a dark red Peugeot slowly in the middle lane near junction 25 of the eastbound M62 (Brighouse).

A lorry driver, who was driving in the left-hand lane of the motorway, was concerned about undertaking Smith, who was alone in the Peugeot.

Smith, who did not have a driving licence and was not insured, drove in front of the lorry driver and broke in front of him. This happened on a number of occasions, Bradford Crown Court heard on Friday, June 2.

The lorry driver was forced to stop on the hard shoulder of the motorway due to Smith's driving.

He then asked Smith what he was doing. The lorry driver said he could smell alcohol on Smith, whose eyes were 'glazed over' and Smith was grunting and making no sense.

The quick-thinking lorry driver grabbed Smith's car keys from his vehicle without Smith seeing and called the police.

Smith was looking for his car keys and waving his fists around and wanted a fight with the lorry driver.

Smith threw a drink bottle at the lorry, which damaged the vehicle. He threw another glass bottle but missed and threw a further three bottles towards the lorry.

Smith left the scene and was later found in Brighouse and arrested. A breath test was taken which read 78 microgrammes of alcohol per 100 millilitres of breath. The legal limit is 35 microgrammes. Smith was arrested.

He told officers he had taken 12 Xanax tablets, which are used to treat anxiety and panic disorders, on the day of the incident and was taken to hospital, but refused treatment.

The offence took place at around 4.30pm on August 8 last year.

Austin Newman, mitigating, told the court: "He (Smith) has no clear recollection of the events of that day. They were committed when he was at a very low ebb of his life. He was struggling with depression.

"He was self-medicating with Xanax. He regrets his conduct, particularly towards the complainant."

Smith, of no fixed address but formerly of Normanton, West Yorkshire, was jailed for a total of 12 months for offences of dangerous driving, criminal damage and driving without insurance or a licence. He pleaded guilty to all of the charges.

Sentencing, Recorder Simon Myerson KC told Smith: "There was a real risk to other road users. You were not in control. Your behaviour afterwards was stupid."
