A BRADFORD man avoided being banned from driving as he has a mortgage to pay.

Amar Hussain, of Naden Close in Horton Bank Top, was caught speeding earlier this year.

Court documents say he avoided a totting disqualification because his mitigating circumstances - loss of business and impact on family - would mean he would be unable to pay his mortgage.

For this latest offence, which carries six penalty points, the 31-year-old was going 48mph in the 30mph zone of St Enoch's Road, between Moore Avenue and Southfield Lane, adjacent to Haycliffe Lane.

This was contrary to sections 81(1) and 89(1) of the Road Traffic Regulation Act 1984 and Schedule 2 of the Road Traffic Offenders Act 1988.

He was fined £160 and had to pay court costs of £110 and a £34 victim surcharge.

Hussain admitted to the speeding charge in Bradford Magistrates' Court on Thursday, September 22.
