A MAN has avoided jail for drink driving in Bradford.

Lee Pemberton, 35, of Hill Top Lane, Bradford, faced two charges of driving a motor vehicle when alcohol level was above the limit and failing to provide specimen for analysis – vehicle driver.

In the first charge, he drove a motor vehicle on a road, namely Thornton Road, Bradford, after consuming so much alcohol that the proportion of it in his breath, namely 164 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. This offence took place on June 27, 2021.

Pemberton was committed to prison for 12 weeks, suspended for 18 months, for the offence. He was also ordered to pay £310 costs and a £128 victim surcharge.

He was also disqualified from holding, or obtaining, a driving licence for 29 months for this charge.

Pemberton was committed to prison for 12 weeks, suspended for 18 months, to run concurrently, for failing to provide a specimen for analysis at Bradford on November 28, 2021.

He was also handed a rehabilitation activity requirement for these two offences. A collection order was made by the court.

Pemberton pleaded guilty to both charges and was sentenced at Bradford & Keighley Magistrates’ Court on July 13, 2022.
