A MAN who was given a restraining order on January 15 this year not to contact his estranged wife, has been handed a conditional discharge for 12 months after admitting breaching the order.

Michael Morgan, 56, of Brindley Wharf, Skipton, had been told not to contact Rossalin Morgan after he caused a fracas at the Coniston Hotel when he found his wife in a room with a naked man earlier this year.

Skipton magistrates were told on Friday that Morgan had been seen in a car with his wife on April 9 this year.

Defending, Siobhan White said Mrs Morgan had sent a text message to her client to meet to talk.

They had gone for a drive in his vehicle and parked in Halton West where the vehicle was spotted by a police officer.

On investigation the officer discovered the pair were subject to a restraining order and Morgan was later arrested.

Morgan pleaded guilty to the breach saying his wife had contacted him over concerns for one of their children. The child is now living with Morgan.

The bench heard there was no provision in the original restraining order to contact one another directly or indirectly over childcare concerns.

Magistrates agreed it was a minor breach over concern for a child and ordered Morgan be given a conditional discharge for 12 months. He was also ordered to pay court costs of £85 and a surcharge of £22.
