A 35-YEAR-old man has been spared jail after breaking in to a house in Bradford and stealing a mobile phone while the owner lay asleep on the sofa.
Richard Thorpe, of Ryefield Avenue, Clayton, had been drinking when he tried the door at a house rented by Ashley Huddleston in Bellerby Brow, Buttershaw.
Mr Huddleston was asleep in the living room on October 1, with his Samsung Galaxy Note 8 smartphone charging next to him.
Bradford Crown Court heard how he awoke at 2am to find Thorpe three feet from him, who then ran off with the phone.
The phone was tracked and Thorpe was found in possession of it.
When arrested he said he had been drinking and could not remember anything about the evening.
Judge David Hatton QC handed Thorpe a six-month suspended sentence.
