NOTICE OF DETERMINATION M62 JUNCTION 10 TO 12 SMART MOTORWAY - ALL LANE RUNNING ENVIRONMENTAL IMPACT ASSESSMENT DETERMINATION UNDER SECTION 105AB (1)(B) OF THE HIGHWAYS ACT 1980 [AS AMENDED)
Highways England gives notice that it has been determined that the M62 Junction 10 to 12 Smart Motorway - All Lane Running proposal which is a relevant project within the meaning of section 105ZA (2) of the Highways Act 1980 (as amended) is not subject to environmental impact assessment in accordance with Part 105A of the Highways Act 1980 (as amended). This is due to the fact that there are no likely significant effects on the environment when taking into account the characteristics and location of the development, and the type and characteristics of the potential impacts. This conclusion has taken into account design and mitigation measures to avoid or prevent significant adverse effects on the environment including a number of industry best practice mitigation measures which will be delivered via a Construction Environmental Management Plan (CEMP). Mitigation measures include noise mitigation in proximity to construction piling activities such as alternative quieter methods of piling and restriction of working hours; lane 1 low noise road surfacing and inclusion of two new noise barriers will enhance the noise environment; where possible, retention of vegetation and reinstatement of screening planting lost for construction; replacement planting designed to enhance the floristic and structural diversity of habitats; and, where required, works will be carried out under a European Protected Species Mitigation Licence.
