CITY OF BRADFORD METROPOLITAN DISTRICT COUNCIL HIGHWAYS ACT 1980 - SECTION 119 PUBLIC FOOTPATH NO. 43 (QUEENSBURY) (PART) SUMMER HAZE COTTAGE PAW LANE QUEENSBURY PUBLIC PATH (DIVERSION) ORDER 2017 On 28th September 2017, the City of Bradford Metropolitan District Council confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order, as confirmed, is to divert that part of Public Footpath No. 43 (Queensbury) as shown by a bold continuous line on map no. 66666/T228/Order Plan annexed to the Order which commences at a point marked A and extends for a total distance of 54 metres in a south westerly, then north westerly direction (via a point marked B) to a point marked C at Summer Haze Cottage. This public footpath has a width of 1.2 metres.
An alternative Public Footpath will be created as follows:-
A Public Footpath - 1.2 metres wide, as shown by a bold broken line on
map no. 66666/T228/ Order Plan annexed to the Order which commences
at a point marked C and extends for a total distance of 57 metres in a north
easterly, then south easterly direction (via a point marked D) to a point
marked A. This public footpath has a width of 1.2 metres.
A copy of the confirmed Order and the Order map has been deposited and
may be inspected free of charge at the Customer Services Office, Ground
Floor, City Hall, Bradford during normal office hours. Copies of the Order
and map may be purchased.
The Order comes into force on 26th October 2017, but if a person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act (as amended), or on the ground that any requirement of that Act or of any regulation made under it has not been complied with in relation to the confirmation of the Order, he may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 6th October 2017, make an application to the High Court.
