SIR – In response to Mr Spence’s letter (T&A ,July 22) re Miller Homes and their offer to commute S106 money in respect of affordable homes and education contributions towards the junction works at Greengates.

Mr Spence feels that money for the junction should come solely from the West Yorkshire Transport fund. I don’t want to comment specifically on this alleged offer, however, I felt that I did need to point out that all the schemes being considered by the Transport fund have to have some kind of third party contribution to them.

This can be in the form of 106 or directly from an individual council’s coffers or some other contribution.

This requirement is to ensure that the monies in the Transport fund stretch as far as possible and without third party contributions fewer schemes would be carried out.

Negotiating S106 obligations can be very difficult as usually there are competing needs, all of which are justified, but there is a limit to what can be asked from developers. If the amount is too high then the developer has the right to appeal to the Planning Inspectorate and in the past this has meant the Council has ended up with no contributions at all.
