A MOTION was put before a judge today to formally withdraw criminal proceedings faced by a man who was later shot dead.

Bradford Crown Court was told that there was an outstanding warrant for the arrest of Tyron Charles, who had been facing charges of causing actual bodily harm and failing to surrender to custody.

The body of Mr Charles, 29, of Unity Street South, Bingley, was discovered on moorland off Hillhouse Edge Lane, Oxenhope, last month.

He had last been seen in Denholme in early September and a man has been charged with his murder.

Judge Jonathan Rose was asked to withdraw the warrant, which he granted, but he said he could not close the criminal proceedings as the prosecution had not brought a copy of Mr Charles's death certificate to court.

The case will now be dealt with administratively to formally close the proceedings.

James Sutcliffe, 28, of Hillcrest Road, Denholme, who denies Mr Charles's murder, is due to stand trial at Bradford Crown Court in March next year.
