Deaf pensioner Kenneth Voss banned from all stores after 'number of incidents' at Bingley

A Bingley pensioner is battling a lifetime ban from entering all Co-op stores.

Kenneth Voss, 65, who is deaf and has trouble moderating his voice, says he has been accused of being “loud and rude” at the company’s Bingley store.

Co-op bosses have served him with a Notice of Exclusion which states: “This society is no longer prepared to allow you to enter any of its branches for any reason whatsoever.”

Mr Voss, of York Street, has sought legal advice in his fight to get the ban lifted but his solicitor has been unable to find out the full details of why it has been imposed.

Mr Voss said: “We just want answers.

“I don’t know why – I think it is personal. I am loud because I am hard of hearing. I wasn’t rude.”

Mr Voss and his disabled wife June have written to Co-op chief executive Peter Marks and intend to take their case to the European Court of Human Rights.

“We have been writing to them and so have our solicitors,” said Mr Voss.

Mrs Voss has rheumatoid arthritis and relies on her husband to do the shopping.

She said she felt because he is deaf, and speaks with a loud voice, staff might have mistaken him for being rude.

She said: “In my opinion it is because he talks loudly. It plays on his mind a lot and he takes it as a personal attack.”

In a letter to the Co-op, Mr Voss’s solicitors, Cleck-heaton firm Cadmans, have described the ban as “disproportionate”.

It states: “Our client is profoundly deaf, which makes it difficult for him to monitor the level of his voice.

“Our client categorically denies that he has ever been rude to any member of your staff and indeed would apologise immediately if he thought he had given any offence.”

The Co-op replied that the exclusion would remain, stating: “Mr Voss has been alleged to have caused our employees a significant amount of distress.”

A spokesman for the Co-operative Group told the Telegraph & Argus the ban had been imposed after “a number” of incidents at its Bingley store. It would not specify the circumstances of the incidents.

The spokesman said: “The decision to exclude the customer was taken after a full investigation following a number of incidents at our store. We do not take such action without good reason and the measure is entirely appropriate.”

This sounds like yet another one sided T&A story. I do not believe a company like the coop would ban someone simply for speaking in a lound manner because of his hearing problem. There is clearly more to this than we are being told, so let's have some objectivity here.

You are right, there must be more to this than we read here, anyway I thought any shop or bar could refuse service to anyone without giving a reason.
Of greater concern is how much is all this legal action going to cost and who pays?

We are not told just what the man did or said, but before the ban issued did the Co-op give training to the staff to help dealing with what might be difficult situations?

I know from past experience. People who work in shops should really not have to be trained to deal with idiots and troublemakers (in general, not accusing this guy directly).
.
The co-op also say their staff were "abused" in several "incidents, but will not elaborate. I would like to know exactly what these "incidents" were, because the ban may be totally justified.
.
albion - You'd think it would be that easy to ban someone. But in one shop I worked in years ago, we had to get permission from the area manager. And they were extremely hesitant to ban any "customer", no matter how vile/aggressive/drun
k/ whatever.

Isn't this a private matter between Co-op and Mr Voss? Why has this been published? Does the T&A now give column inches to personal disputes?

Doesn't he have a hearing aid? When people like this start babbling on about "taking it to the european courts of human rights' I know which side is in the right!

It's been publicised by a pathetic local paper with a small minded editorial team just looking to apparently take the side of the individual against the big boys without knowing the facts. Ask the editor of the T&A how many women he employs or promotes in his boys club?

I pay taxes to the government regularly... that doesn't mean I like them or agree with them.
The T&A does not serve Bradford at all well in my view - how did it allow that mess in the centre to occur, why is the editor not screaming blue murder at the council and why is he not trying to promote Bradford - he's past his sell by date. Get a woman in to the role.

so, an illegal immigrant hides a police killer and we can't ban him from our shore, but a nuisance in a co-op can be banned from ALL co-ops. Someone, somewhere is wrong.

Surely it's up to the shop who enters their premises?

If a customer isn't wanted then the shop keeper (the CO-OP) can refuse entry, just as a pub landlord would, or anybody in their own house would.

Which 'human right' is being infringed here?

His right to brand names at low low prices perhaps.

No this is a bit ridiculous. Its the shops right to refuse service to who ever they want. Must definately be a slow news day.

Tracy, I think your appalling grammar is surpassed only by the stupidity of your comments. Clearly you haven't read the story or you would have seen that they didn't ban him for being deaf -what a ridiculous thing to say! The reason was “Mr Voss has been alleged to have caused our employees a significant amount of distress.” during “a number” of incidents! I used to work in the old Safeway store it became Co-op and had the misfortune of serving this guy on several occasions. We all used to dread him coming to our till. Sometimes he was alright and you could have a laugh with him but if he had to queue more than 30 seconds he would start mouthing off saying we were all "slow" and "useless" He used to make a right scene over nothing, I remember one guy having a pop at him because he upset his young daughter when he was shouting his mouth off about something; and he had a girl on the tills in tears when he shouted "get her off, she doesn't know what the bloody hell she's doing"... She refused to serve him after that. This guy's problem isn't moderating his voice - at least, it wasn't when he was in a decent mood - it's thinking he can talk to people like dirt just because they work in a shop. I had to laugh when I read the part that said our client denies he has ever been rude; I remember this bloke better than any other customer from Safeway because he was one of the most rude and offensive people I have ever met.
P.S. Well done to the T&A for insinuating that the fact this man is hard of hearing is somehow connected with him being banned… You may also want to print that according to the RNID website The Co-op raised over 3.3million for this charity last year.

A local newspaper is supposed to support and campaign for the local community it serves. has the editor openly criticised Bradford Council for the city centre mess? I don't think so. I believe the Bishop of Bradford is the only one to speak out against this mess.

Well after not buying the T&A for years I thought I would log on. I now know why I don't buy it. these have a go at a business stories make me angry. Its cheap. If the T&A did this properly, interviewed staff and customers and found foul play, I would back em! however if I worked, owned, was a share holder or a Customer I would be very angry. Of course the Coop can't commet and specify all the incident. does anyone quality check T&A stories???? Lost forever as a customer of the T&A
