A MAN who filmed himself having sex has been given a suspended jail sentence for voyeurism.

The secret recording only came to light after someone told the complainant that he had seen the footage on Rodney Maloney’s computer.

The full details of the offence cannot be revealed to protect the identity of the woman involved, but Judge Jonathan Rose said the 43-year-old defendant had not shown a shred of remorse.

Maloney, of Little Brook, Skipton, was found guilty by a jury of the voyeurism charge following a trial at Bradford Crown Court and Judge Rose noted that the defendant had set up the recording equipment in advance.

The judge said the complainant had been understandably upset and now knew that another person had seen the recording.

Judge Rose told Maloney that the starting point of six months in prison was exactly right in his case, but he then had to decide if it had to be served immediately.

“After giving this a deal of consideration since your trial and after hearing submissions I’ve come to the conclusion that it is not,” the judge told Maloney.

Judge Rose said no work of any great value could be done with Maloney during such a short sentence and he decided that it should be suspended for two years.

But Maloney will now be subject to an electronically-monitored home curfew between 7pm and 7am for the next six months and he must also comply with a 30-day rehabilitation activity requirement.

The court heard today that Maloney suffered from anxiety and depression, but Judge Rose said he had come “within a whisker” of going to prison.

The judge reserved any breaches of the sentence to himself and warned Maloney that he would not be able to draw back from a jail sentence if he came in front of him again.

Maloney will have to register as a sex offender with the police for the next five years.

He will also be subject to a sexual harm prevention order for the same period of time.
