A SECOND driver has appeared before Leeds Crown Court accused of causing the death by dangerous driving of pedestrian James Gilbey on the Stanningley by-pass in July.

Kaiz Mahmood, 28 of Hinchcliffe Street, Undercliffe, Bradford, appeared on bail at the court today for a preliminary hearing when a timetable was set in his case.

Andrew Dallas representing him said he would be denying the charge and the allegation that he was racing his Audi with another vehicle on July 13.

Majid Malik, of Silverhill Avenue, Bradford Moor, has already pleaded guilty to causing the death by dangerous driving of Mr Gilbey.

The 25-year-old was struck by Malik’s Volkswagen Golf car as he was returning home to the Bramley area after seeing a friend in Kirkstall, Leeds.

Malik has also denied racing in his basis of plea. He was remanded in custody until November 30 for prosecutors to decide if they need to hold a Newton hearing when a judge would decide that issue without a jury.

Judge Tom Bayliss QC agreed to adjourn Mahmood’s case until the same date for a plea and case management hearing but also fixed a trial date for him of March 21 next year.

Unconditional bail was continued for Mahmood until the next hearing but he was told by then he must serve a defence statement setting out his case.
