A SCAFFOLDER who flew into a drink-fuelled rage outside a Bradford pub and twice bit a man after damaging his car has been spared an immediate prison sentence.

Kyle Scott attacked Richard Hardstaff near the Greenwood Inn on Bierley Lane, Bradford, after arguing with his girlfriend in the pub on August 6.

Scott, 28, of Manor Park Road, Marsh, Cleckheaton, said he was “going to kill everyone” and urged pub goers to “phone the busies” when he lost his temper, Bradford Crown Court heard.

Scott did £100 damage to the pub landlady’s Vauxhall Corsa by kicking off the wing mirror before damaging Mr Hardstaff’s Vauxhall Astra, prosecutor Ben Campbell said. When Mr Hardstaff challenged him about what he had done to the wing mirror and passenger side window of his car, Scott bit him twice on the back as they scuffled on the ground, the court was told.

He then stole Mr Hardstaff’s £200 phone from his jacket pocket. Mr Hardstaff suffered bleeding and swelling from the bites but did not need hospital treatment, the court was told.

Scott made no comment to the police when he was arrested.

He pleaded guilty to two offences of criminal damage, assaulting Mr Hardstaff occasioning him actual bodily harm and stealing his iPhone 5.

Scott had previous convictions for battery and criminal damage, Mr Campbell said.

Ben Thomas, Scott’s barrister, conceded that the assault crossed the custody threshold but urged Judge David Hatton QC to suspend the sentence.

“He has finally grown up and taken steps not to drink alcohol and he is in work and keen to engage with the probation service,” Mr Thomas said.

Scott had a young daughter he was spending time with, instead of going out drinking. Judge Hatton sentenced Scott to nine months imprisonment, suspended for 12 months, with 150 hours of unpaid work and a rehabilitation activity requirement. He said the public would be better served if Scott engaged with the probation service to tackle his drink-fuelled offending. Scott was ordered to pay £500 compensation to Mr Hardstaff.
